By accessing or using Underpriced AI ("Service"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our Service.

Underpriced AI provides AI-powered tools for resellers, including item identification, valuation estimates, listing generation, and marketplace integration. The Service is provided "as is" and "as available."

Our Service uses artificial intelligence to analyze images and generate content. You acknowledge that:

When you connect third-party accounts (such as eBay), you agree to comply with their terms of service. We are not responsible for the actions, content, or policies of third-party platforms.

Some features help you prepare or transfer listing content to third-party marketplaces — for example, our browser extension can pre-fill a Facebook Marketplace listing form with your item's details. These are assistive tools: nothing is ever posted to a third-party platform without your review and your explicit action, and we never access, store, or collect your credentials or data from those platforms. You are responsible for your accounts on third-party platforms and for complying with their terms of service, and you acknowledge that those platforms may change or restrict how their services work at any time. Underpriced AI is not affiliated with or endorsed by Meta, Facebook, eBay, Poshmark, Mercari, or any other marketplace.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UNDERPRICED AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

You agree to indemnify and hold harmless Underpriced AI, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

We may suspend or terminate your access to the Service at any time, with or without cause. Upon termination, your right to use the Service will immediately cease. You may also delete your account at any time.

We reserve the right to modify these Terms at any time. We will notify users of significant changes by posting a notice on our website or sending an email. Continued use of the Service after changes constitutes acceptance of the new Terms.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If unsuccessful, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules.

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

Paid plans are subscriptions billed in advance on a recurring basis (monthly or annual, depending on the plan you choose). Your subscription automatically renews at the end of each billing period at the then-current price for your plan, and your payment method is charged, until you cancel. Monthly plans renew monthly; annual plans renew annually. You authorize us, through our payment processor Stripe, to charge your payment method for each renewal.

You can cancel at any time from your Settings, from the cancellation link in any billing email, or by emailing support@underpricedai.com. Cancelling stops future renewals; you keep access through the end of your current paid period. We send a reminder before annual renewals.

If we change subscription prices, we will notify you in advance, and the new price applies to your next renewal.

Monthly subscriptions and one-time credit or scan-pack purchases are non-refundable. When you cancel a monthly plan, you keep access until the end of the current billing period; we do not prorate or refund partial months.

For annual subscriptions, on request we will refund the unused full months remaining in your term; partial months are not refunded. Any goodwill refund we choose to grant may be net of non-recoverable payment-processing fees.

Free scans require no payment and are not subject to refund.
